AGREEMENT TO OUR LEGAL TERMS
We are Shree Ambica Info Services ("Company," "we," "us," "our"), a sole-proprietorship firm registered in India at 19, Bhagyanidhi, Ghatlodia, Ahmedabad- 380061.
We operate the mobile application ‘Dinzyy’ (the "App" or Dinzyy), as well as web/mobile application ‘Dinzyy - Restaurants’ (the “App for Restaurants” ) and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").
The ‘App’ provides table booking as well as meal-booking services to users whereas the ‘App for Restaurants’ provides restaurant management services, which is to be used solely by restaurants, food-outlets, meal-vendors, cloud-kitchen or any other vendors associated with us but not categorized here (collectively, “Dinzyy Vendors”, “Entities”, “Registered Entities”). For more details refer below terms and conditions. Customers who avail various services such as table-booking, meal-booking using Dinzyy at any registered entities shall be addressed as customers/general customers in this document. General customers shall avail services through Dinzyy app, while entities shall avail services through Dinzyy- Restaurants

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") registered with us, and Shree Ambica Info Services, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms will become effective upon posting or notifying you as stated in the email message. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.
1. OUR SERVICES
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The services provided by the App and the App for Restaurants are specifically designed for the Republic of India. Please note that the App will only work in the cities/towns where Dinzyy Vendors have registered with us.
2. INTELLECTUAL PROPERTY RIGHTS
2.1 Our intellectual property
We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").
The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use only.
2.2 Your use of our Services
Subject to your compliance with these Legal Terms, including the "PROHIBITED ACTIVITIES" section below, we grant you a non-exclusive, non-transferable, revocable license to:
access the Services; and
download or print a copy of any portion of the Content to which you have properly gained access.

Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our prior written permission.
If you wish to make any use of the Services, Content, or Marks, please address your request to: info@dinzyy.in. If we ever grant you the permission to post, reproduce, or publicly display any part of our Services or Content, you must identify us as the owners or licensors of the Services, Content, or Marks and ensure that any copyright or proprietary notice appears or is visible on posting, reproducing, or displaying our Content.
We reserve all rights not expressly granted to you in and to the Services, Content, and Marks.
Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.
2.3 Your submissions and contributions
Please review this section and the "PROHIBITED ACTIVITIES" section carefully prior to using our Services to understand the (a) rights you give us and (b) obligations you have when you post or upload any content through the Services.
Submissions: By directly sending us any question, comment, suggestion, idea, feedback, or other information about the Services ("Submissions"), you agree to assign to us all intellectual property rights in such Submission. You agree that we shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
Contributions: The Services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality during which you may create, submit, post, display, transmit, publish, distribute, or broadcast content and materials to us or through the Services, including but not limited to text, writings, video, audio, photographs, music, graphics, comments, reviews, rating suggestions, personal information, or other material ("Contributions"). Any Submission that is publicly posted shall also be treated as a Contribution.
You understand that Contributions may be viewable by other users of the Services and possibly through third-party websites.
When you post Contributions, you grant us a license (including use of your name, trademarks, and logos): By posting any Contributions, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to: use, copy, reproduce, distribute, sell, resell, publish, broadcast, retitle, store, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part), and exploit your Contributions (including, without limitation, your image, name, and voice) for any purpose, commercial, advertising, or otherwise, to prepare derivative works of, or incorporate into other works, your Contributions, and to sublicense the licenses granted in this section. Our use and distribution may occur in any media formats and through any media channels.
This license includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide.
You are responsible for what you post or upload: By sending us Submissions and/or posting Contributions through any part of the Services or making Contributions accessible through the Services by linking your account through the Services to any of your social networking accounts, you:
confirm that you have read and agree with our "PROHIBITED ACTIVITIES" and will not post, send, publish, upload, or transmit through the Services any Submission nor post any Contribution that is illegal, harassing, hateful, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening to any person or group, sexually explicit, false, inaccurate, deceitful, or misleading;
to the extent permissible by applicable law, waive any and all moral rights to any such Submission and/or Contribution;
warrant that any such Submission and/or Contributions are original to you or that you have the necessary rights and licenses to submit such Submissions and/or Contributions and that you have full authority to grant us the above-mentioned rights in relation to your Submissions and/or Contributions; and
warrant and represent that your Submissions and/or Contributions do not constitute confidential information.
You are solely responsible for your Submissions and/or Contributions and you expressly agree to reimburse us for any and all losses that we may suffer because of your breach of (a) this section, (b) any third party's intellectual property rights, or (c) applicable law.
We may remove or edit your Content: Although we have no obligation to monitor any Contributions, we shall have the right to remove or edit any Contributions at any time without notice if in our reasonable opinion we consider such Contributions harmful or in breach of these Legal Terms. If we remove or edit any such Contributions, we may also suspend or disable your account and report you to the authorities.
2.4 Copyright infringement
We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes upon any copyright you own or control, please immediately refer to the "COPYRIGHT INFRINGEMENTS" section below.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (5) you will not use the Services for any illegal or unauthorized purpose; and (6) your use of the Services will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).
4. USER REGISTRATION
You may be required to register to use the Services using your Email and mobile number. Users can change their login email under user account settings. You agree to keep your password confidential and will be responsible for all use of your account and password. Users should refrain from using temporary mail for registration since all transactions such as sign-up, login email change, password-recovery will be accessed through OTP sent to a registered Email address. Users are required to establish and utilize a distinct username to enhance their engagement with the application's functionalities. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
5. TERMINOLOGIES- APPLIED TO CUSTOMERS AND ENTITIES
5.1 General Terminologies
5.1.1 Restaurants
As per Dinzyy norms, ‘Restaurants’ are formally designated as establishments that undertake the preparation and provision of food and beverages to patrons. Such provisions are intended for consumption on the premises, which are required to feature appropriate seating arrangements inclusive of tables and chairs.
5.1.2 Waiting outside a Restaurant
Remaining in the vicinity of a restaurant's premises while awaiting entry or service (i.e. waiting to sit at the table).
5.1.3 Meal/Food Outlet
An establishment or venue offering prepared meals or food items for purchase or consumption. Typically provides quick service or operates in a casual dining format.
5.1.4 Cloud Kitchen
Also known as a ghost kitchen or virtual kitchen, a cloud kitchen is a commercial food production facility that operates solely for the purpose of fulfilling delivery or take-out orders placed through online platforms, without providing dine-in services.
5.1.5 Book A Meal/Meal-booking
In the context of Dinzyy, the process of pre-ordering a meal, typically a food-outlet, cloud-kitchen other than restaurants (because for restaurants, a separate ‘Hunger Mode’ is there for this purpose), typically to save customer’s time.
5.1.6 Take-away
The option provided by restaurants or food outlets for customers to order and collect prepared food items for consumption off-premises, often packaged in containers suitable for transport.
5.1.7 Food- Delivery
A service that facilitates the delivery of prepared meals or food items from restaurants or food outlets to customers' desired locations. Please note that Dinzyy does not facilitate this service as of now as our primary focus is on other services.
5.1.8 Platter
In the context of Dinzyy, a "platter" can be defined as a virtual container or repository within the application interface where users can assemble and organize their selected food items for ordering. Similar to a physical serving platter used in dining, the virtual platter serves as a centralized space where users can view, review, and manage their chosen items before finalizing their order. It facilitates a seamless and user-friendly experience for the customers to browse, select, and customize their meal choices within the application.
5.1.9 Booking Time
In the context of Dinzyy, the term "Booking Time" encompasses various meanings contingent upon its usage:
A. When employed within the scope of Hunger mode (Refer 6.3), "Booking Time" denotes both the time of table reservation and meal booking. During this period, a table will be reserved for the user, and their meal will be promptly served.
B. In the context of Pre-booking mode (Refer 6.4), "Booking Time" exclusively pertains to the time of table reservation.
C. Within the framework of Book A Meal feature (Refer 6.5.1), "Booking Time" signifies the time at which the meal will be prepared and made available for the user at the designated entity.
D. In the context of Take-away (Refer 6.5.3), "Booking Time" indicates the time when the meal will be prepared and packaged for collection at the selected entity.
These distinctions delineate the multifaceted interpretations of "Booking Time" within the parameters of Dinzyy's services.
5.1.10 Username
A username is a unique alphanumeric identifier chosen by a user to serve as their digital identity on a Dinzyy. It is utilized for the purpose of distinguishing individual users and facilitating their access to various features and functionalities within the platform. Users have the autonomy to set their own username.
5.1.11 QR codes
In the context of Dinzyy, QR codes are dynamically generated. By scanning these QR codes or having them scanned by others, users can access various functionalities and features within the app.
5.1.12 Add On
A food-item add-on refers to any supplementary item, ingredient, or accompaniment that is offered alongside a primary food item or meal, typically intended to enhance the flavor, presentation, or nutritional value of the main dish. This may include but is not limited to condiments, side dishes, toppings, garnishes, sauces, or any other additional component that can be optionally included or selected by the consumer to complement the main food item. Additionally, variations in the primary food’s specifications (such as size), which the user must choose from, are also considered under the add-on category. A user may incur additional pricing while selecting add on.
5.1.13 Banquet
A banquet refers to a large event space designed to accommodate gatherings such as formal dinners, receptions, ceremonies, or other special occasions. These venues typically feature spacious seating arrangements, elegant decor, and amenities suited for hosting large groups of people. Banquet facilities are equipped with amenities such as tables, chairs, audiovisual equipment, lighting, and catering services to support various events. They may be found within hotels, event centers, restaurants, or standalone venues, and they provide a versatile setting for a wide range of social and corporate functions.
5.1.14 Scope/Role
This term does not applicable to general customers.
In the context of Dinzyy, "scope" refers to the extent or range of authority, responsibilities, or operations that an individual is authorized to oversee or engage with within the platform. Each role within Dinzyy has a defined scope that delineates the specific entities, functionalities, or operations it encompasses. The scope defines the boundaries within which individuals can operate and make decisions within the Dinzyy platform, ensuring clarity and accountability in their roles and responsibilities.
5.2 Payment/Legal Terminologies
5.2.1 Basic Price
The base cost of a meal or food item on a restaurant's menu (shown in Dinzyy app) before the addition of taxes, fees, or discounts. Dinzyy vendors retain full discretion in determining the price, and Dinzyy assumes no responsibility in the price-setting process.
5.2.2 Taxes
Mandatory charges levied by the government on the sale of goods and services, including meals and food items sold by restaurants.
5.2.3 Discount
A reduction in the price of a meal or food item offered by a restaurant, typically provided as a promotional incentive or reward for customers.
5.2.4 GST
A consumption tax levied by the government on the sale of goods and services, including meals and food items sold by restaurants. GST rates may vary depending on the jurisdiction and type of food item. Typically GST in India has been divided in parts viz, SGST, CGST and IGST. However, as far as services related restaurants are concerned SGST and CGST will be applicable and its total shall be GST. GST shall be on the basic price of food/meal (if not discounted), service or packing charges, platform fees and payment processing fees.
5.2.5 GST Number
The unique identification number assigned to a restaurant or food outlet by the government for the purpose of GST compliance and tax reporting. Restaurants registered with Dinzyy must provide GST number (if they have available) to Dinzyy and that number shall also be available on Dinzyy app.
5.2.6 FSSAI Certification
The certification issued by the Food Safety and Standards Authority of India (FSSAI) to restaurants and food outlets, indicating compliance with food safety and quality standards set by the regulatory authority. It is compulsory for Dinzyy’s vendors to upload and verify this certification, otherwise they will not be approved.
5.2.7 Packing Charges
Fees imposed by restaurants or food outlets for packaging and preparing take-away orders, covering the cost of materials and labor involved in packing food items for off-premises consumption. Dinzyy vendors retain full discretion in determining the price, and Dinzyy assumes no responsibility in the price-setting process.
5.2.8 Service Charges
Fees added to the bill by restaurants to cover the cost of providing service to patrons. Dinzyy vendors retain full discretion in determining the price, and Dinzyy assumes no responsibility in the price-setting process.
5.2.9 Table-booking Charges
Table-booking charges refer to the amount paid by customers to reserve a table at a restaurant. While some restaurants impose these charges, others do not. The collected charges are remitted to the restaurant after deducting necessary fees. Generally, these charges are reimbursable and are applied towards the final bill.
5.2.10 Tips to waiter
Voluntary gratuities or monetary rewards provided by patrons to waitstaff as appreciation for good service, typically in addition to the bill.
5.2.11 Platform-fees (Charged by Dinzyy)
Charges imposed by Dinzyy for facilitating transactions between customers and restaurants or food outlets, covering the cost of platform maintenance, marketing, and transaction processing. Both customers and vendors need to pay platform-fees to Dinzyy for each transaction within Dinzyy app.
5.2.12 Payment-processing fees (Charged by Dinzyy)
In the event that a customer conducts any payment via the payment gateway integrated within the Dinzyy application, restaurants are obligated to remit a predetermined percentage of transaction fees to Dinzyy. This percentage may be subject to periodic revisions. This fee is implemented in accordance with Dinzyy's integrity policy, as it encompasses the costs incurred by Dinzyy for transaction processing services provided by third-party payment gateways, as well as associated taxes levied on said fees.
5.2.13 Other-fees (Charged by Dinzyy)
As of now Dinzyy does not charge any fees other than mentioned in 5.2.10 and 5.2.11 and does not plan to do so in near future.
5.2.14 Records
In the context of Dinzyy, records refer to comprehensive data sets encompassing various aspects of operational activities within the platform, including but not limited to order history, booking history, employee history, orders served, taxation details, and other relevant information. These records serve as immutable repositories of transactional and operational data essential for compliance, auditing, and regulatory purposes. They are maintained within the system with viewing rights only, ensuring that they remain intact and unaltered, thereby preserving the integrity and accuracy of the information contained therein.
5.2.15 Settlement
Settlement refers to the process where Dinzyy reconciles financial transactions with entities, transfering funds as per agreed terms. It involves remitting payments to or collecting payments from entities at predefined intervals ensuring smooth financial operations.
5.2.16 Settlement period
Settlement period refers to the predefined interval to carry-out settlement between entity and Dinzyy. Settlement period shall be varied from entity to entity as per agreed upon terms. Generally (not compulsorily) settlement period shall be between 4 to 15 days.
6. DINZYY SERVICES - TERMS & CONDITIONS FOR CUSTOMERS AND USER-GUIDE
Dinzyy extends the following services, subject to the terms and conditions outlined below. Users (general customers as well as entities) are urged to thoroughly review these terms, as they serve as instructive guidelines for the utilization of the services provided:
6.1 General
6.1.1 Terms and conditions
Users are required to possess a valid Dinzyy account in order to use most of the features provided by Dinzzy app.
Dinzyy provides various services to the users and terms and conditions mentioned in section- 6 are applicable to general customers that are different from Dinzzy registered vendors/entities.
Photographic materials, including images of tables, restaurant exteriors and interiors, banquet settings, food items, and any other relevant visuals not explicitly enumerated herein, are uploaded and managed by vendors affiliated with Dinzyy. While Dinzyy retains the authority to remove such materials in instances of copyright infringement or violations of applicable laws, as stipulated in Section 2 of this document, it cannot warrant the absolute accuracy of the provided information. However, in case of any issues faced by customers or other third parties, Dinzyy shall investigate upon reporting through appropriate means. This investigation shall be conducted diligently and in accordance with the procedures outlined in the terms and conditions governing dispute resolution.
Table-details, food/meal-details, all pricing, discount, hunger-mode ON and OFF (if applicable), pre-booking mode ON and OFF (if applicable) and any other relevant details are set by vendors. Dinzyy cannot warrant the absolute accuracy of the provided information. However, in case of any issues faced by customers or other third parties, Dinzyy shall investigate upon reporting through appropriate means.
Dinzyy levies platform fees from customers in exchange for the services rendered. The determination and regulation of platform fees shall be subject to the terms and conditions delineated in subsequent sections of this agreement.
The practical examples provided in this section are intended for the purpose of enhancing user comprehension and facilitating a clearer understanding of the stipulated provisions. These examples serve as illustrative aids to elucidate the application and implications of the outlined terms and conditions. It is imperative to note that these examples are provided solely for convenience and do not supersede or alter the legal validity or enforceability of the terms and conditions themselves.
TABLE-BOOKINGS
Subsections 6.2, 6.3 and 6.4 describe various types of table-bookings a customer can carry-out at Dinzyy’s registered entities. These are guidelines cum terms and conditions for bookings. It is recommended to go through it before commencing booking to ensure a smooth booking experience.
Consistently monitoring push notifications is integral to ensuring the effectiveness of the booking system. Therefore, customers are strongly encouraged to maintain an active internet connection and regularly check notifications received through the Dinzyy application for all bookings.
6.2 Table Booking Services - Normal Booking
6.2.1 Salient Features
The table booking service enables users to reserve table(s) at establishments that are registered with Dinzyy. This service provides users with real-time access to tentative availability information. Additionally, users can access table images, features, table- seating capacity, and other relevant data. Users are required to specify the number of guests, upon which the system will automatically identify suitable tables. If the number of guests exceeds the capacity of available tables, users will be redirected to the group-table booking option, facilitating the reservation of multiple tables.
While users also have the option to make bookings directly at the reception desk of restaurants registered with Dinzyy, it is advisable for them to book independently using their own account. This allows users the freedom to select a table of their preference.
6.2.2 Terms and Conditions for users - Normal Booking (Single table booking)
Users are required to possess a valid Dinzyy account in order to initiate table booking processes. Without a Dinzyy account, users will be unable to proceed with any booking transactions.
Table booking services are exclusively available at restaurants that are duly registered with Dinzyy. Users may only make reservations at such registered establishments.
Dinzyy provides photographic representations of each table along with accompanying feature descriptions, which are updated by the respective restaurants. It is acknowledged that there may be discrepancies between the provided photographs and the actual table features. In such instances, Dinzyy absolves itself from any liability or responsibility.
Prior to making a booking, Dinzyy requests users to specify the number of adults and children accompanying their party. Users are urged to provide accurate details, as inaccuracies may result in complications when allocating seating arrangements. In cases where erroneous information is provided, neither Dinzyy nor the restaurant assumes responsibility for accommodating additional space for users. It is emphasized that both Dinzyy and the restaurant reserve the right to cancel bookings in situations where the number of individuals specified in the booking exceeds or falls short of the actual number present. In dinzyy’s context, adults are defined as individuals aged 18 and above, children as those between the ages of 2 and 18. The total number of guests shall comprise the number of adults and the number of children.
Using guests-data (i.e. number of guests) provided by guests, Dinzyy will show recommendations based on the number of guests and capacity of tables. Users may take a note that they will not be shown all the tables of the restaurant as the tables shown to users will be decided by Dinzyy’s proprietary algorithm.
In case, a restaurant has multiple tables location then a user can filter tables based on location as well.
Our system utilizes optimization algorithms designed to show minimum waiting times and offer users the most efficient table options. However, it is important to note that Dinzyy cannot be held liable for delays in table availability at actual than system generated availability time, as unforeseen circumstances involving human factors may occur. Same way, the table will be available to you before system generated availability time. Dinzyy's operations are primarily algorithmic in nature.
Users are mandated to be within a 50-meter radius of the restaurant they intend to book. Failure to meet this requirement will result in the disallowance of the booking request. This measure is implemented to ensure fairness and to mitigate system errors resulting from multiple booking cancellations. If users find themselves physically present at a restaurant premises yet encounter difficulties in completing a booking, it is plausible that such issues may arise from GPS inaccuracies. In such instances, users are encouraged to seek assistance from the restaurant manager to facilitate the booking process.
Frequent cancellation of bookings will negatively impact users' Customer Reliability Rating (CRR). In instances of low CRR, users may face restrictions on their booking privileges. This policy is enforced to deter users from engaging in excessive booking activities. Further terms and conditions about CRR have been defined in subsequent sections.
When your booked table becomes available or is about to become available, you will receive a push notification (the preferred method of communication) or a text message on your mobile number. In rare cases, notifications or text messages may not reach you on time due to unavoidable technical issues. You may report such rare cases to Dinzyy. Upon receipt of the message, please open your booking QR code and have it scanned by the booking admin or hospitality admin. You will be guided by the staff. It is your responsibility to arrive on time. If you fail to meet the booking manager within 3 minutes, your phone number will be disclosed to them. If you fail to arrive within 5 minutes, you will lose your booking. Additionally, if you do not respond after being called, you will lose your booking as well as your Customer Reliability Rating (CRR). The ability to reclaim your booking will be at the sole discretion of the booking manager or the entity's manager. Dinzyy assumes no responsibility in such cases.
This booking system operates on a real-time basis. Consequently, there exists a minor possibility that the table being booked by a user may also be reserved by another user or by the restaurant on behalf of another user, due to disparities in the timing of the booking transactions. In such instances, the user's booking may either fail or succeed. Even if the booking is successful, the actual availability time of the table may significantly differ from the time indicated by the system. In the event of such rare occurrences, it is strongly advised that the user promptly contacts the restaurant manager to either cancel or modify the booking. Dinzyy disclaims any responsibility for bookings in such special cases.
The same tables reserved under the Normal booking mode are also subject to integration with the pre-booking mode and hunger-mode by other users (both of them are detailed in subsequent sections of this document). Consequently, there are rare instances where tables displayed as "AVAILABLE" during the booking process may ultimately result in booking failures. In such cases, Dinzyy bears no responsibility. Users are requested to carry-out booking again when such failures happen.
Users are prohibited from maintaining multiple bookings simultaneously. Upon booking success, the system shall redirect users to the current booking page and prevent further booking attempts to ensure compliance with this policy. Please note that multiple bookings are different from group booking.
During wait times, users have the option to pre-order their meals in advance. Additional details regarding this feature are provided in the forthcoming section titled Advanced Meal Order.
It is recommended for users to check the table status from time to time for their own ease. It is also possible that restaurant staff may need a couple of minutes for cleaning the table or completing other necessary tasks of table preparation. In that case, users are requested to have patience.
After table-booking, a user can provide access to the guests belonging to their group. Such access will be limited and will be governed by terms and conditions mentioned in “After Booking - Limited Guest Access” in subsequent sections of this document.
Once guests have seated on table, they can enjoy other Dinzyy services mentioned in subsequent sections (After-booking Services) of this document.
Users to pay platform fees for each transaction done through Dinzyy app. Table-booking is a part of that transaction.
It is important to understand that in certain situations, the Hospitality Admin may decide to optimize wait times by canceling and rebooking tables on user’s behalf within the entity's system. However, this will only occur after obtaining explicit confirmation from the user. To facilitate this process, a designated button will be provided to seek the user's permission. It's essential to note that any rebooking of tables will only proceed after the user has provided explicit consent. While this process aims to improve customer experience, it's important to acknowledge that human judgment is involved, and Dinzyy does not assume responsibility for any errors that may occur during this transaction.
6.2.3 Terms and Conditions for users - Normal Booking (Group tables booking)
As previously stated, if the number of guests exceeds the capacity of the available tables, users will be navigated to utilize the group-table booking option, enabling the reservation of multiple tables. It is noteworthy that multiple logins are not required to book multiple tables; a single login is sufficient for this purpose. In the group-table booking option, the App presumes that you want to sit next to each other.
While the Group booking feature facilitates the reservation of multiple tables, it is important to note that at their core, these tables remain individual entities. Therefore, the terms and conditions governing single tables shall be applicable (except sr no. 13. In group bookings users may not be able to carry out advanced meal orders) to group bookings.
Group booking provides you with two options : A. Adjacent booking B. Straight-line Adjacent booking
Dinzyy will present automatically generated recommendations to users for group booking. These recommendations are formulated based on factors such as the number of guests, the combined capacity of tables, and table availability. To enhance user convenience, a group of recommended tables will be presented as a "SET," comprising adjacent tables for “Adjacent booking” option, whereas comprising adjacent tables in straight-lines for “straight-line Adjacent booking”. It should be noted that a set may have a capacity exceeding the number of guests. Within a set, users will be provided with information regarding individual table availability times. Users are required to select tables until the total capacity of the selected tables equals or exceeds the number of guests. It is advisable that users exercise their own judgment based on the availability times indicated for individual tables to achieve optimal results.
Similar to single table booking, users can provide access to the guests belonging to the group. For this type of booking, users can provide access individually for each table using a simple generate and scan QR code method. Provision of such table-wise access is called ‘Table Assignment’ (Refer 6.6.1). It is mandatory to assign all the tables belonging to the (booked) group. Such access will be limited and will be governed by terms and conditions mentioned in ‘After Booking - Limited Guest Access’ in subsequent sections (6.6.2) of this document.
Single table cancellation from a set of booked tables is not allowed. Users need to cancel the entire set and similar to the single booking option, cancellation will affect customer CRR.
Similar to single-booking, there is a rare chance of booking failure for a table or tables from a set even while previous status was shown as “AVAILABLE” during the booking process. In such cases, Dinzyy bears no responsibility. Users are requested to carry-out group-booking again when such failures happen.
In the context of the prevailing custom in India, the practice of combining multiple tables for a group is commonly observed. Given Dinzyy's tailored design for users in the Indian subcontinent, table joining is permissible for "Straight-line Adjacent booking" but not for "Adjacent booking." However, it is imperative to note that the ultimate decision regarding table joining rests with the respective restaurant. Dinzyy disclaims any responsibility for the decisions made by the restaurant in this regard.
As group bookings entail reservations for multiple tables, it should be noted that tables may not become available for seating simultaneously. Users are advised to confirm their booking for the earliest available table and subsequently repeat the process for any additional tables as they become available. Confirmation method is similar to ‘single-table’ as the user just needs to show QR code and the restaurant shall scan the QR code.
After successful QR code scan, users will be escorted to the designated table by restaurant staff. It is recommended that users periodically monitor the status of their table for convenience. Additionally, users are advised to exercise patience should the restaurant staff require additional time for table preparation or cleaning tasks. In the event that other tables remain occupied, guests are requested to remain patient.
The aforementioned procedure applies to all upcoming tables associated with the group booking.
In group booking, users can not pre-order their meals.
Once guests have seated on table, they can enjoy other Dinzyy services mentioned in subsequent sections (After-booking Services) of this document.
6.3 Table Booking Services - Hunger Mode
6.3.1 Salient Features:
The table booking service enables users to reserve a table and book a meal at establishments that are registered with Dinzyy. Users are required to specify the number of guests, upon which the system will automatically identify the suitable tables. To carry out booking with this mode, a user needs to mention the approximate (the more precise the better) arrival time at the restaurant. After booking completion users need to select the meal they wish to have. Users can either pay full or partial amounts as ‘advance amount’ (Further, advance amount will be governed by conditions given herein). Only upon successful payment, Hunger mode booking shall be considered completed. Later the user will be provided the selected table and served the meal at booking-time. If the number of guests exceeds the capacity of available tables, users may not be able to book using this mode (For instance a restaurant has a table with maximum seating capacity of 12, then you can not book for more than 12 persons using single booking) . In a nutshell, Hunger mode is only for single table booking.
6.3.2 Terms and Conditions for users - Hunger Mode Booking
Conditions Sr no. 1,2,3 and 4 from 6.2.2 - Normal mode booking- single table, will be applicable here as well.
Should a restaurant registered with Dinzyy choose to deactivate hunger mode, users will not have the option to book a table along with a meal using this mode.
Using guests-data (i.e. number of guests) provided by you, Dinzyy will show suitable tables at the restaurant selected by you. After selecting a table, turn on the slider button to initiate hunger-mode.
You will be asked the time when you will reach the restaurant. Here provide as exact time (“hunger booked-time”) as possible because at ‘hunger booked-time’, your meal will be ready for you. However, you can only select time between ‘after 30 minutes from now’ till either ‘after 5 hours from now or 45 minutes before closing time of restaurant whichever is earlier’ considering the practicality of this mode. For example, if the current time is 7 pm and a restaurant selected by you closes at 11:30 pm, then you can select the time from 7:30 pm to 10:45 pm.
You will be provided with system-generated suggestions. Dinzyy’s proprietary algorithm will generate these suggestions as accurately as possible. However, Dinzyy bears no responsibility for the accuracy or reliability of such suggestions. During weekends and festivals, you may be required to select from system-suggested times rather than your preferred times. This policy is implemented for the convenience of both the restaurant and the user.
After hunger mode booking-time selection, you will be redirected to the booking confirmation page. In rare cases of other simultaneous bookings, you will face a booking failure. In that case, you are requested to carry out booking once again.
Once you have received success with booking, you are requested to go to the meal page and select the meal-items you like and add it onto the platter (see 5.1.8). Further, you need to go to that page and then carry-out advance payment (‘Advance Amount’ for Hunger mode).
The 'Advance Amount' for Hunger mode serves as a security measure to mitigate potential losses incurred by the restaurant in the event of booking cancellation. As a customer, when you place an order for a meal to be prepared at the 'hunger booking-time,' you are entering into an agreement with the restaurant. Should you cancel your booking, the advance amount paid will be refunded to the restaurant after necessary fees (Refer 5.2.10, 5.2.11 and 5.2.12) are deducted. Conversely, if you proceed with the order, the advance amount will be deducted from your final bill. The restaurant determines the minimum percentage of the total order value that must be paid as the advance amount. Users have the option to pay either the entire amount or the minimum required percentage. (For instance, if your order value amounts to Rs. 1500 and the restaurant's minimum percentage is 40%, you must pay at least Rs. 600 as the advance amount for Hunger mode. In the event of order cancellation, the advance amount will be refunded to the restaurant after deduction of necessary fees by Dinzyy. However, if you proceed with the order and incur additional expenses of Rs. 300 at the restaurant during dining (resulting in a final total order value of Rs. 1800), your final bill amount will be calculated as the final total order value minus the advance amount paid, resulting in Rs. 1200.) It is important to note that the determination of the order value is governed by the Order value clause outlined herein.
Completion of the hunger mode booking is contingent upon Dinzyy's receipt of the advance payment. Failure to remit payment results in an incomplete booking, for which neither Dinzyy nor the restaurant assumes responsibility.
A user must reach at least five minutes before ‘hunger booked-time’ and provide confirmation of arrival to the restaurant. Approximately five minutes prior to the allocated booking time, a confirmation button will become available or activated. Even while using this button, you need to be within 50 meters of the restaurant otherwise you will not be able to confirm booking. This feature serves to confirm the user's presence at the restaurant premises. Failure to confirm the booking within a seven-minute timeframe may prompt the restaurant manager to request the user's contact information, which Dinzyy will disclose. In such circumstances, users will be contacted to confirm their booking within the designated time frame. Failure to do so may result in the reassignment of the booking to other parties. Subsequently, neither Dinzyy nor the restaurant will assume responsibility for the unconfirmed booking.
In rare cases of GPS errors, if you are unable to confirm booking, you are requested to contact the restaurant manager.
After pressing the confirmation button, a user may show their booking-confirmation page at restaurant reception and guests will be guided to the booked table by restaurant staff. It is recommended for users to check the table status from time to time for their own ease. It is also possible that restaurant staff may need a couple of minutes for cleaning the table or completing other necessary tasks of table preparation. In that case, users are requested to have patience.
Users are prohibited from maintaining multiple bookings simultaneously. The system may redirect users to the current booking page and prevent further booking attempts to ensure compliance with this policy.
Unlike Normal booking, users may not be able to provide “Limited Guest Access” to the other users.
Once guests have seated on table, they can enjoy other Dinzyy services mentioned in subsequent sections (After-booking Services except Limited Guests Access) of this document.

6.4 Table Booking Services - Pre-book Mode
6.4.1 Salient Features:

Users are required to specify the number of guests, upon which the system will automatically identify the suitable tables. To carry out booking with this mode, a user provides booking time at the restaurant. If the number of guests exceeds the capacity of available tables, users may not be able to book using this mode as Pre-book mode is only for single table booking (For instance a restaurant has a table with maximum seating capacity of 12, then you can not book for more than 12 persons using single booking).
6.3.2 Terms and Conditions for users - Table Booking Services (Pre-book)
Conditions Sr no. 1,2,3 and 4 from 6.2.2 - Normal mode booking- single table, will be applicable here as well.

6.5 Meal Booking Services
The meal-booking services offered encompass two distinct components: Book A Meal and Take-away, with minor disparities in their operational functionalities (Refer 5.1.5 and 5.1.6 respectively). It is hereby established that while both services share common terms and conditions, there exist certain exceptions specific to each component. Therefore, the general terms and conditions shall apply uniformly to both services, with the necessary amendments and exclusions delineated to accommodate their respective functionalities.
6.5.1 Salient Features: Book A Meal
‘Book A meal’ pertains to the advanced reservation of food items, commonly associated with food-outlets, cloud kitchens or other casual dining entities (with no particular table-chair arrangement like a traditional restaurant), distinct from the functionality tailored for traditional restaurants termed 'Hunger Mode'. This practice is instituted with the aim of expediting the conserving time resources of the customers. Users can simply choose an outlet (other than a restaurant) they like, provide approximate time of their arrival, select meal-items of their liking, do advance-payment (partial or full) and then upon their arrival their meal will be ready for them (not packed). Upon showing booking-id and OTP it will be provided to them. In case, they have done partial payment, they can either choose to pay from Dinzzy or pay directly to the concerned entity.
6.5.2 Salient Features: Take-away
‘Take-away’ pertains to the advanced reservation of food items that will be prepared as per your requirements and preferably kept packed upon your arrival, commonly applicable to all entities registered with Dinzyy. This practice is instituted with the aim of expediting the conserving time resources of the customers. Users can simply choose an outlet (other than a restaurant) they like, provide approximate time of their arrival, select meal-items of their liking, do advance-payment (partial or full) and then upon their arrival their meal (in packed condition) will be ready for them. Upon showing booking-id and OTP it will be provided to them. In case, they have done partial payment, they can either choose to pay from Dinzzy or pay directly to the concerned entity.
Customer can book in two methods: Provide time (1 hours from now). Say required now (here they will be provided with time from entity).
6.5.3 Terms and Conditions for users - Meal-Booking
Users are required to possess a valid Dinzyy account in order to initiate meal booking processes. Without a Dinzyy account, users will be unable to proceed with any booking transactions.
Meal booking services are exclusively available at entities (except ‘Book A Meal’ is not available for traditional restaurants, instead hunger mode is provided with similar functionality) that are duly registered with Dinzyy.
Dinzyy provides photographic representations of food items with accompanying feature descriptions, which are updated by the respective restaurants. It is acknowledged that there may be discrepancies between the provided photographs and the actual food. In such instances, Dinzyy absolves itself from any liability or responsibility.
Some food-items may not have photographs set by restaurants, in that case, users may need to rely on their own judgment by item title and description. Food item details are also set by vendors. It is acknowledged that there may be discrepancies between the details and the actual food. In such instances, Dinzyy absolves itself from any liability or responsibility.
Once you have selected meal items (i.e. added into the ‘Platter’), you can proceed with advanced payment (‘Advance Amount’ for Meal-Booking)
The 'Advance Amount' for Meal-Booking serves as a security measure to mitigate potential losses incurred by the vendor in the event of cancellation from the user. As a customer, when you place an order for a meal to be prepared at the 'booking-time,' you are entering into an agreement with the restaurant. Should you cancel your booking, the advance amount paid will be refunded to the restaurant after necessary fees (Refer 5.2.10, 5.2.11 and 5.2.12) are deducted. Conversely, if you proceed with the order, the advance amount will be deducted from your final bill. The vendor determines the minimum percentage of the total order value that must be paid as the advance amount. Users have the option to pay either the entire amount or the minimum required percentage. (For instance, if your (Primary) order value (Refer) amounts to Rs. 150 and the vendor’'s minimum percentage is 30%, you must pay at least Rs. 45 as the advance amount for Book A Meal. In the event of order cancellation, the advance amount will be refunded to the vendor after deduction of necessary fees by Dinzyy. Your final bill amount will be calculated as the final total order value minus the advance amount paid, resulting in Rs. 105. (In this instance, it has been assumed that the customer has not purchased anything other than the original order)) It is important to note that the determination of the order value is governed by the Order value clause outlined herein.
Completion of the meal-booking is contingent upon Dinzyy's receipt of the advance payment. Failure to remit payment results in an incomplete booking, for which neither Dinzyy nor the restaurant assumes responsibility.
Following a successful booking, users are entitled to visit the vendor's establishment at the designated booking time. It is expected that, in most instances, the meal will have been prepared (packed in case of Take-away) accordingly. However, in rare circumstances where the vendor requires additional time beyond the stipulated booking time, users are encouraged to exercise patience. Should a customer perceive significant negligence on the part of the vendor, it is advisable to submit a report detailing the vendor's delayed activity.
Upon arrival at the vendor's premises, users are requested to present either the booking page or confirmation email to the vendor. These documents contain all pertinent information necessary for order processing. Subsequent to verifying the provided information and settling any outstanding dues (of total order amount), if applicable, the vendor will proceed to furnish the meal items reserved by the user. It is important to note that Book A Meal mode of service does not encompass the provision of packed meal items. For such offerings, users are advised to opt for the Take-away option.
6.6 Banquet Booking Services
The Dinzyy app provides photographic representations and details of banquet facilities and services, which are uploaded and maintained by the respective restaurants. Users are advised that while Dinzyy strives for accuracy, variations may occur between the provided photographs and the actual banquet facilities. Dinzyy shall not be held liable for any discrepancies.
Banquet pricing packages are determined and set by the respective restaurants or banquet facilities. Users are encouraged to review the pricing details provided within the Dinzyy app for each banquet facility before making a booking.
The acceptance or rejection of banquet booking requests is at the discretion of the respective restaurants or banquet facilities. Dinzyy facilitates the booking process but does not have control over acceptance decisions made by the establishments.
Users are required to pay the advanced amount, as decided by the concerned restaurant, for booking banquet facilities through the Dinzyy app. The booking shall be considered as 'confirmed' only after it is accepted by the concerned restaurant. In the event of rejection by the restaurant, Dinzyy shall refund the total amount to the customer, including any platform fees charged from the customer. However, restaurants are liable to pay platform fees even in the event of rejection.
An email/push-notification to the concerned restaurant will be sent upon a booking request, while an email/push-notification to the concerned customer will be sent upon acceptance of the booking request.
Dinzyy shall charge platform fees for banquet bookings, payable by both the restaurants and users. These fees contribute towards the maintenance and operation of the Dinzyy app platform.
The availability of banquet facilities is subject to prior bookings made through the Dinzyy app. Users are advised to check the availability of their preferred banquet facilities before initiating the booking process.
Users are required to specify the start and end times for the usage of the banquet facilities during the booking process. Any extension of the booking duration beyond the initially specified times may result in additional charges, as determined by the respective restaurants or banquet facilities.
Dinzyy serves solely as a platform for facilitating banquet bookings and does not assume liability for any issues arising during the usage of banquet facilities. Users acknowledge that any disputes or concerns regarding the banquet facilities or services should be addressed directly with the respective restaurants or banquet facilities.
However, in the event that users encounter any problems or issues with the banquet facilities booked through the Dinzyy app, they are encouraged to report such incidents to Dinzyy. Upon receipt of a report, Dinzyy shall promptly investigate the matter and take appropriate actions as necessary to address the concerns raised by the users.
6.7 Other Features and terms & conditions
6.7.1 App Launch and User Intention
Upon launching the app, the system will show the nearest entity (if available) or redirect to the Restaurant Page. However, in case of on-going booking, you will be redirected to existing booking related pages. This is to avoid multiple bookings.
Upon launching the Restaurant page/food-outlet page, a dialogue box will be opened. That is to know the user's intention of the type of service required. For instance, a user can select Dine-out for dine-out related services (6.2, 6.3, 6.4) such as single/group table bookings, pre-booking, hunger mode etc.
Users can change intentions by pressing a center button on the Navigation bar. However, during an on-going transaction, it can not be changed.
6.7.2 Select A Restaurant/Food-outlet
For selection of a restaurant or a food-outlet, separate pages are provided for ease of the users. Whichever entity satisfies criteria of Restaurants- 5.1.1, shall be in page Restaurants and all other entities shall be in page Food-outlet.
A user can select a restaurant/food-outlet from respective pages. Moreover, filtering, sorting and searching facilities have been provided for augmented user-experience.
6.7.3 Add to platter & proceed
A user can select meal items and add to Platter (Refer 5.1.8). Further, he can move to a platter to view the selected items (also items that have been served can be seen during Dine-out).
An option for customization has also been provided in case of customized meal-items.
PROCEED button is provided at the platter page to proceed further. In case of hunger and meal-booking modes users will be redirected to the payment page and after payment confirmation their orders will be confirmed, while during ‘normal’ dine-out, an order for selected items shall be given to the kitchen as payment will be at last during this mode.
6.7.4 After Table-Booking Services - Table Assignment and Limited Guests Access
The "Table Assignment" feature is specifically applicable to instances of 'Group-Table Booking' as delineated in Section 6.2.3 of this document. Conversely, 'Limited Guest Access' functionality extends to both single and group table bookings, as outlined in Sections 6.2.2 and 6.2.3, respectively.
Within the framework of Dinzyy, "Table Assignment" refers to the process wherein an administrator user, having conducted a group booking, can designate reserved tables (pertaining to the group booking) to other users. 'Limited Guest Access,' on the other hand, is designed to grant ordering privileges to other users associated with either single or group bookings. By leveraging both functionalities, an administrator user can delegate ordering autonomy to designated individuals, thereby decentralizing the ordering process and distributing responsibilities amongst group members. In simpler terms, 'Table Assignment' facilitates the provision of table-specific 'Limited Guest Access' to individuals within the group.
To utilize both functionalities, individuals must possess a valid Dinzyy account with a designated username.
An administrator user can activate Table Assignment following the successful completion of a group booking transaction. The group booking page will display individual table statuses alongside an option to provide Table Assignment access. Upon selecting this option, a prompt will appear enabling swift addition for Table Assignment. It is important to note that Table Assignment is conducted on a table-by-table basis. While for a single table, users can activate limited guest access from the booking confirmation page following a similar methodology.
Billing and payment for the entire group of tables or a single table will be consolidated into a single transaction, and no separate billing arrangements shall be permitted. Individuals assigned a table will not be authorized to conduct billing and payment operations.
Both Table Assignment and Limited Guest Access functionalities are applicable only for the duration of a single transaction. For instance, if an administrator user allocates tables to other individuals during a group booking, such assignments shall remain valid solely for the duration of that particular transaction and will be nullified thereafter.
Once Table Assignment or Limted Guests Access has been provided for a single transaction, administrators are precluded from modifying such assignments. Therefore, it is imperative that Table Assignment is carried out with meticulous consideration and attention to detail.
The user who is providing the “limited guest access” is solely responsible for the orders placed by other users. //check
6.7.5 After Table-Booking Services - Waiter Services
While Dine-out, a user can give instructions to the waiter.
Although some generalized pre-defined instructions have been provided, a user may give custom instructions as well.
It may take some time for the waiter to follow these instructions, hence users are requested to have patience until then.
6.7.6 Order Value
Order Value embodies the collective financial considerations pertinent to transactions within the application framework, encompassing diverse elements crucial in determining the total expenditure incurred by users. These elements include the Basic Price, SGST (State Goods and Services Tax), CGST (Central Goods and Services Tax), service charges (relevant in Dine-out contexts), packing charges (applicable for Take-away arrangements), platform fees, GST on platform fees, GST on service charges, tips, and discounts, where applicable. The Order Value reflects the comprehensive financial commitment assumed by users in accessing services or procuring products, as elucidated in section 5.2 for comprehensive understanding of associated terminologies.
The Basic Price serves as the foundational cost attributed to the selected goods or services, upon which subsequent charges and deductions are predicated. SGST and CGST denote the state and central levies respectively, imposed on transactions in adherence to prevailing tax statutes.
In instances involving customized items, the customer is obligated to remit payment comprising the original Basic Price in addition to the prices attributed to any associated 'Add-ons'. Therefore, for customized items, the Basic Price shall be adjusted to reflect the total amount inclusive of the corresponding 'Add-on Price'.

Similarly, packing charges, relevant in Take-away scenarios, reflect costs incurred for packaging ordered items for convenient transportation, with establishments setting these charges.
Platform fees constitute charges levied by the application provider for transaction facilitation and platform infrastructure maintenance. GST on platform fees represents the goods and services tax imposed on these charges in compliance with statutory regulations, with Dinzyy being responsible for setting platform fees.
GST on service charges denotes the taxation applied to service charges incurred during Dine-out transactions. Discounts, when applicable, are subtracted from the Basic Price to ascertain the adjusted transaction value, upon which taxes are computed. Taxes are applied on the net amount (Basic Price minus discounts) for precise tax calculation.
The final Order Value is contingent upon diverse factors, including the quantity and type of products or services selected by users, underscoring the necessity for meticulous computation and transparent disclosure to ensure financial transaction clarity and equity within the application framework.
Generous tips provided to waiters are integrated into the Order Value. However, customers retain discretion in choosing whether to remit tips via Dinzyy or directly in cash.
For hunger and meal-booking functionalities, the Order Value shall be delineated into two distinct categories: the Primary Order Value and the Final Order Value. The Advanced Amount shall be contingent upon the Primary Order Value, encompassing the total value of the order prior to booking finalization (i.e. when you are not at the entity and have selected meal-items in advance). Conversely, the Final Order Value is ascertained when the customer is on the brink of completing the transaction (i.e. after reaching at entity if you have selected additional items than original order selection), encapsulating the Basic Prices, taxes, and additional charges incurred for any supplementary meal orders beyond the original selection.
Additionally, it is imperative to note that any partial advanced payments made for hunger and meal booking modes will be deducted from the Final Order Value.
Customers are obligated to settle all outstanding dues based on Final Order Value.
Customers are encouraged to reach out to us in case of any grievances relating to Order Value.
6.7.7 Discounts and Promotional Offers
Discounts and promotional offers provided within the Dinzyy app are subject to availability and may vary based on factors such as time, location, and participating restaurants.
The majority of discounts and promotional offers are provided by affiliated restaurants and vendors. Dinzyy serves as a platform to facilitate the dissemination of these offers to users.
Each discount or promotional offer will have a specified validity period during which it can be availed. Users are encouraged to review the terms associated with each offer to ascertain its validity.
The details of each discount or promotional offer, including any terms and conditions set by the respective restaurant or vendor, will be clearly specified within the Dinzyy app.
Users must adhere to the redemption process outlined for each discount or promotional offer.
Discounts and promotional offers may be subject to certain limitations, such as usage restrictions, maximum redemption limits, or exclusions on specific menu items or services. Users are advised to review these limitations before availing an offer.
Unless explicitly stated otherwise, discounts and promotional offers are non-transferable and cannot be exchanged for cash or combined with other offers, unless permitted by the terms of the offer.
Dinzyy reserves the right to modify, extend, or withdraw any discount or promotional offer at its discretion, without prior notice to users or affiliated restaurants or vendors.
Users are responsible for ensuring that they meet any eligibility criteria specified for availing discounts or promotional offers. Dinzyy shall not be liable for any disputes arising between users and affiliated restaurants or vendors regarding offer eligibility or redemption.
Users agree to comply with all applicable laws and regulations while availing discounts or promotional offers through the Dinzyy app.
6.7.8 CRR
Customer Reliability Rating (CRR) is a metric utilized for assessing the reliability of customers within the framework of the Dinzyy's operations. It functions as a standardized measurement mechanism intended to evaluate the dependability and trustworthiness of individual customers.
The implementation of CRR is motivated by the imperative to mitigate potential disruptions to the system resulting from the unreliability of certain customers. By quantifying the reliability of customers through structured evaluation criteria, the application endeavors to uphold operational integrity and maintain a seamless user experience for all stakeholders.
CRR operates in accordance with predefined algorithms meticulously designed to analyze and interpret various factors indicative of customer reliability. These algorithms are crafted to ensure fairness, consistency, and objectivity in the assessment process, thereby fostering a transparent and equitable environment for all users.
One of the key determinants influencing CRR is the frequency of booking cancellations by customers. Customers who frequently cancel bookings may experience a decrement in their CRR.
Conversely, customers who rarely cancel bookings or demonstrate consistent adherence to reservation commitments are less likely to experience depletion in their CRR.
Customers with a low CRR may encounter limitations on their booking privileges, particularly during peak demand periods such as rush hours.
6.7.9 Payment
Users can carry-out payment with either cash at the entity or through a third party payment gateway provided in the app.
Remarkably, while doing advanced payment for meal-booking or hunger mode, cash is not a feasible option. Hence, it is mandatory to carry-out payment with a third party payment gateway.
However, while carrying out final payment, users can opt cash at the entity.
An OTP is to be provided to the cash-counter of the entity to confirm the cash-payment. Once confirmed by the entity, your cash-payment shall be considered completed.

6.7.10 Dinzyy Coins
Dinzyy may award Dinzyy Coins to customers as a token of appreciation upon order placement. Number of Dinzyy coins to be allotted shall be solely decided by Dinzyy.
Dinzyy Coins hold no monetary value and cannot be used for any financial transactions.
Dinzyy coins have their own expiry dates decided by Dinzyy. Post expiry-date, these expired coins shall be deducted from your coin balance. Users are requested to monitor this.
Upon account deletion your coin balance shall be zero and will remain zero even after account reactivation.
Dinzyy Coins are intended for participation in engaging games offered by Dinzyy, providing users with the opportunity to win exciting prizes. Coins may be useful to avail discounts, too.
Users are solely responsible for monitoring their Dinzyy Coin balance.
The use of Dinzyy Coins is subject to the Terms and Conditions set forth by Dinzyy. Users are advised to review these terms before engaging in any activities involving Dinzyy Coins.
6.7.11 Dinzyy Games
Dinzyy offers various games where users can utilize Dinzyy Coins for participation.
Users may have the chance to win enticing prizes through Dinzyy Games. These prizes may include physical objects, digital rewards, or other items as specified by Dinzyy.
In the event that a user emerges as a winner in a game where physical objects are offered as prizes, Dinzyy will need the user's address for the seamless delivery of the reward. Therefore, users are required to update their delivery address accordingly. Further after victory, failure to update your address within 48 hours in the Dinzyy app may result in the cancellation of your prize.
Comprehensive information about Dinzyy Games, including rules, conditions, and prize details, can be found in the Terms and Conditions mentioned in each game. Users are encouraged to review these terms carefully for a gratifying gaming experience.
If Dinzyy identifies malpractice by a user, it reserves the right to revoke any awarded prize or deactivate the user's account.
Dinzyy reserves the right to terminate Dinzyy games at any time without prior notice.
7. DINZYY SERVICES- TERMS AND CONDITIONS FOR DINZYY VENDORS AND USER GUIDE
This section applies to the Vendors registered with Dinzyy for provision of their services to the general customers. These vendors are restaurants, food-outlets, cloud-kitchens, meal-vendors and other meal serving entities not categorized here.
The practical examples provided in this section are intended for the purpose of enhancing user comprehension and facilitating a clearer understanding of the stipulated provisions. These examples serve as illustrative aids to elucidate the application and implications of the outlined terms and conditions. It is imperative to note that these examples are provided solely for convenience and do not supersede or alter the legal validity or enforceability of the terms and conditions themselves.
7.1 Registration with Dinzyy
7.1.1 Terms and conditions
Entities have the option to either carry out self-registration or seek assistance from Dinzyy personnel, with the latter being the preferred method.
Entities are required to carefully read and understand all terms and conditions, including those applicable to customers, and must adhere to them strictly.
There are no charges associated with entity registration on the Dinzyy platform.
Upon first-time registration, entities are obligated to provide the main email address of the entity or owner, which will serve as the administrator account. This account will be used for delegating the authority.
During registration, entities must clearly indicate the type of establishment they represent, choosing from options such as restaurants, quick service establishments, or cloud kitchens (Refer 7.2 carefully before proceeding). In the event of a dispute concerning the classification of entity type, the final decision shall rest with Dinzyy, and all involved entities are bound by this determination.
Entities are mandated to provide all required details as outlined in the registration process.
Separate login credentials will be provided for staff members, with login and approval procedures governed by the terms and conditions specified in Section 7.4.
Entities are expected to comply with all settlement conditions outlined by Dinzyy. Failure to do so may result in registration deletion or legal action.
Dinzyy personnel will guide entities through the onboarding process, providing necessary support and guidance to staff members for efficient app utilization.
Dinzyy reserves the right to display posters near the entrance or within accessible areas of the entity premises to inform customers about the Dinzyy application. These posters will contain a QR code for expedited redirection to the respective entity page.
During the registration process, it is mandatory for entities to furnish legal particulars including Goods and Services Tax (GST) registration details (if applicable) and Food Safety and Standards Authority of India (FSSAI) certification (mandatory).
If Goods and Services Tax (GST) registration is not applicable, the vendor must provide a physical declaration stating the non-applicability of GST. Declaration shall be in standard Dinzyy format. (Format)
All certificates and declarations shall undergo verification by Dinzyy personnel before the registration process commences. Failure to furnish the required certificates or declaration will render the registration process invalid.
Additionally, vendors are required to submit a scanned copy of cancelled cheque or provide bank details for settlement in accordance with the settlement clause outlined in this document.
7.1.2 Initial Set-up
Write what type of help will be provided for initial set up of Dinzyy services.
7.2 Description of Entity
Dinzyy has defined entities registered with it in three major categories. Following is detailed description and terms & conditions to be followed by registered vendor :
7.2.1 Restaurants
Dinzyy defines "Restaurants" as establishments formally engaged in the preparation and provision of food and beverages to customers.
Such establishments are obligated to ensure that the provided food and beverages are suitable for consumption on the premises, which must include adequate seating arrangements comprising tables and chairs.
Restaurants are expected to adhere to local health and safety regulations governing food preparation, storage, and service.
The quality and freshness of ingredients used in food preparation are of paramount importance, and restaurants are required to maintain high standards in this regard.
Any special dietary requirements or restrictions specified by customers must be accommodated to the best of the restaurant's ability.
Restaurants must ensure cleanliness and hygiene in all areas accessible to customers, including dining areas, restrooms, and food preparation areas.
Compliance with all applicable licensing and regulatory requirements, including those related to food safety (FSSAI), sanitation, and business operations, is mandatory for restaurants registered with Dinzyy.
Vendors in this category will be able to enjoy all the services related to Dinzyy except banquet booking services, which is subject to the following condition.
Further Restaurants may or may not have banquet facilities. However, restaurants with banquet facilities may carry-out separate registration for banquet booking services.
7.2.2 Quick Service or Casual Dining Establishments
Quick service or casual dining establishments are characterized by their provision of prepared meals or food items for purchase or consumption.
These establishments typically operate in a fast-paced environment, catering to customers seeking convenient dining options.
Quick service establishments, including but not limited to food courts, local snack shops, fast-food outlets, cafes, and retail food chains, are encompassed within this category.
Quick service or casual dining establishments are required to maintain cleanliness and hygiene standards in all areas accessible to customers, including dining areas and food preparation stations.
Timeliness and efficiency in food service are essential for ensuring customer satisfaction, and these establishments are expected to prioritize prompt order processing and delivery.
Menu offerings should be diverse and reflective of customer preferences, with options available to accommodate various dietary requirements and preferences.
Compliance with all relevant health and safety regulations (FSSAI) and licensing requirements is mandatory for quick service or casual dining establishments registered with Dinzyy.
Vendors in this category will not be provided with only meal-booking services.
7.2.3 Cloud Kitchens (Ghost Kitchens/Virtual Kitchens):
A cloud kitchen, also known as a ghost kitchen or virtual kitchen, refers to a commercial food production facility exclusively dedicated to fulfilling delivery or take-out orders placed through online platforms.
Unlike traditional restaurants, cloud kitchens do not offer dine-in services and operate primarily as delivery hubs for online food orders.
Cloud kitchens are expected to maintain stringent standards of food safety, cleanliness, and hygiene in accordance with regulatory guidelines.
The efficiency and timeliness of order fulfillment are crucial for ensuring customer satisfaction, and cloud kitchens must prioritize prompt delivery of orders.
Menu offerings should be clearly communicated to customers through online platforms, and any updates or changes to the menu should be promptly reflected.
In the event of any issues or discrepancies with orders, cloud kitchens are responsible for providing timely resolution and addressing customer concerns to ensure a positive dining experience.
Vendors in this category will not be provided with only meal-booking services.
7.3 Data-provision/Data-modifications rules
7.3.1 Photographs of facility
Restaurants (7.1.1) are obligated to upload genuine and illustrative photographs of their establishment, encompassing interior and exterior views, dining facilities, and any other pertinent visual content to ensure users receive an authentic representation.
Cloud kitchens and quick service establishments (7.1.2, 7.1.3) may opt out of uploading photographs of the facility; nevertheless, it is advisable to provide them to enhance customer confidence and satisfaction.
Dinzyy shall bear no responsibility for any discrepancies or erroneous information provided by the entity.
7.3.2 Tables and Table Arrangements
Restaurants are obligated to furnish precise and comprehensive details concerning the availability of tables, their configuration, seating capacity, and any other pertinent information pertaining to the seating arrangement. Such information must be provided on a per-table basis, and restaurants are mandated to assign unique numerical identifiers to each table. This numerical designation facilitates precise management of bookings and orders.
In addition to statistical information, photographic documentation is deemed essential to enhance customer satisfaction. Restaurants are mandated to furnish such visual representations in accordance with the stipulated requirements.
The authority to provision and modify these details is vested in accounts designated as administrators and managers.
Dinzyy's restaurant application provides the necessary arrangements for the provision and modification of data to facilitate seamless management and accuracy.
In the event of adding, removing, or modifying a table, restaurants are requested to promptly update the relevant data accordingly, ensuring accuracy and consistency in the representation of their establishment's seating layout on the platform.
It is expressly understood that Dinzyy shall bear no liability arising from the provision of false or inaccurate information by the restaurant. Restaurants are solely responsible for the accuracy and completeness of the data provided, and any discrepancies or inaccuracies shall be addressed by the restaurant in accordance with applicable policies and procedures.
7.3.3 Food Details
Restaurants are obligated to furnish comprehensive details regarding the food items they offer, encompassing menu descriptions, ingredient lists, dietary specifications, portion sizes, and any other pertinent information.
Restaurants retain the authority to create, modify, or delete items at their discretion, encompassing the setup of descriptions, pricing, types, photographs, and all other pertinent details.
Restaurants are also required to ensure that photographs of food items adhere to the guidelines outlined for user-generated contributions.
Any additional offerings, such as meal add-ons, side dishes, condiments, or complementary items, must be clearly specified by the restaurant, with pricing for add-ons also determined by the restaurant.
It is mandatory for restaurants to accurately categorize their food items and add-ons into distinct categories such as vegetarian, eggetarian, and non-vegetarian to facilitate user selection based on dietary preferences.
Transparent pricing information, inclusive of the costs associated with individual menu items, meal packages, combos, and any applicable taxes or service charges, must be provided by the restaurant.
The authority to provision and modify these details is vested in accounts designated as administrators and managers.
Additionally, restaurants are responsible for ensuring that all information provided is accurate and up-to-date, and Dinzyy shall bear no liability for any false or misleading information provided by the restaurant.
7.3.4 Staff Details
Dinzyy serves as a platform designed to facilitate entities in managing their table bookings, meal bookings, and back-end operations efficiently. In order to ensure smooth operation and enhanced security, it is encouraged that staff members provide valid identity cards and upload their photographs. Dinzyy is committed to safeguarding this data and will only share it with authorized entity administrators.
Staff members are required to possess a valid Dinzyy account in order to access and utilize Dinzyy services effectively. This ensures accountability and enables seamless coordination within the platform.
Restaurants or entities are responsible for clearly defining the roles and responsibilities of their staff members. By delineating standardized categories, such as waiters, chefs, or managers, entities can delegate appropriate authority to their staff members. For instance, waiters may be authorized to place food orders on behalf of customers, thereby streamlining the dining experience.
Standardized categories have been provided by Dinzyy to assist restaurants and entities in defining clear roles and responsibilities for their staff members. This categorization framework facilitates efficient management and ensures that each staff member understands their duties and obligations within the establishment. (Refer login credentials 7.4)
Dinzyy shall not assume any liability for inaccuracies or incorrect information provided by the entity.
7.3.5 Offers
Vendors are requested to go through Terms and conditions for customers mentioned in 6.7.7 before proceeding with offer settings.
Restaurants and entities offering discounts and promotional offers through the Dinzyy app are required to ensure the accuracy and validity of the offers they provide.
Dinzyy serves as a platform to facilitate the dissemination of these offers to users, and as such, restaurants and entities must adhere to the terms and conditions set forth within the app.
Each discount or promotional offer must have a specified validity period, terms, and redemption process, which will be clearly outlined within the Dinzyy app.
Restaurants and entities have the authority to set their own offers and promotional codes, with the rights to do so vested in the administrator or manager account.
It is the responsibility of restaurants and entities to ensure that their offers comply with all applicable laws and regulations.
Dinzyy reserves the right to modify, extend, or withdraw any offers at its discretion, without prior notice to users or affiliated restaurants or entities.
Restaurants and entities agree to cooperate with Dinzyy in resolving any disputes that may arise regarding offer eligibility or redemption.
Furthermore, Dinzyy shall not be held liable for any disputes between users and affiliated restaurants or entities regarding offer eligibility or redemption.
7.3.6 Banquet Details
Banquets are required to provide accurate photographic representations and details of their facilities and services to be displayed on the Dinzyy app. These representations must accurately depict the banquet's interior, exterior, dining areas, and any other relevant visual content.
Banquets are responsible for determining and setting their pricing packages clearly mentioning GST and other necessary details. The details of these packages must be updated to Dinzyy for display on the app as adding/updating/deleting facility is provided in Dinzyy app. Setting up of the pricing package also includes defining the appropriate percentage of total package value to be paid as advance-payment by the customers.
The authority for provision and modification of these details is vested in accounts designated as administrators and managers.
7.3.7 Certificates
Restaurants are obligated to upload authentic certifications and licenses, including but not limited to Goods and Services Tax (GST) documentation (if applicable), Food Safety and Standards Authority of India (FSSAI) certification, health permits, hygiene ratings, and any other regulatory approvals as mandated by local authorities.
Restaurants are required to periodically update these certificates as necessary.
These certificates shall remain confidential and shall only be disclosed to authorities upon request. They shall be made available on the Dinzyy platform. The Dinzyy team reserves the right to periodically review these certifications to ensure quality assurance for customers.
7.4 Types of Login/Rights provided
The following are the types of login credentials provided to entities for managing various bookings and services of the entity on the Dinzyy platform. It is important to note that not all entities are required to have access to all types of logins. Entities have the autonomy to select roles from the following list based on factors such as the type and size of the entity, among others :
7.4.1 Administrator
The administrator must possess a valid Dinzyy account to access the backend system.
Typically, the administrator is the initial individual designated by Dinzyy to represent the entity and manage backend operations. The administrator may subsequently delegate rights to other personnel within the entity. Typically, the owner of the entity assumes the role of administrator, or an individual approved by the owner may serve as the administrator. It is recommended that Administrator rights remain with the owner.
The administrator is empowered to approve, modify, and delete all roles delineated in this subsection 7.4, with the exception of their own role within scope.
The administrator account holds overarching authority across all roles and possesses the capability to view and modify various aspects within the defined scope, excluding modification of records (Refer 5.2.13) of including own scope.
In cases where the administrator oversees a chain of entities, they retain authority (mentioned in sr no. 4) over all entities within their chain.
Therefore, the scope of the Administrator's authority shall be confined to encompass either a singular entity or multiple entities falling under the ownership of an owner.
The administrator has access to detailed information such as order details, taxation records, staff information, staff attendance records, platform fee details, and settlement information within scope. Administrator shall be responsible for preservation of records.
Important communications, including changes to terms and conditions, adjustments to platform fees, and other significant updates, will be directed to the administrator's designated email address for timely review and action.
The administrator shall not share their login credentials or password with any other individual, as the administrator account holds the highest level of authority. Dinzyy shall not assume responsibility for any events or consequences arising from the sharing of the administrator's password.
Administrator rights shall be provided to all entities, regardless of their size or type, to ensure effective management of backend operations. However, the provision of an administrator account shall be restricted to one account per owner. In exceptional circumstances, Dinzyy reserves the final authority to approve the provision of additional administrator accounts.
The Administrator is required to communicate with the Dinzyy team for any inquiries, issues, or reports related to the account. The Dinzyy team is also responsible for assisting with the initial setup of the Administrator account. In the event of any issues raised by customers and addressed to Dinzyy within scope, the administrator assumes responsibility for responding to inquiries and cooperating with any investigations or findings conducted by Dinzyy.
The Administrator is hereby instructed to thoroughly review the Terms and Conditions, Privacy Policy, and Refund Policy for appropriate management of accounts.
7.4.2. (Entity) Manager
The Manager must possess a valid Dinzyy account to access the backend system.
The Manager's scope is confined to a single entity, even if the owner oversees a chain of restaurants. The managerial role is specific to individual entities and cannot extend beyond this.
Appointment and removal of Managers shall be carried out by the Administrator. Only the Administrator holds the authority to designate individuals as Managers within the Dinzyy backend system.
Managers possess the capability to appoint and remove personnel for various roles within their designated entity, with the exception of the Administrator role (7.4.1) and the Manager role itself (7.4.2). This authority enables Managers to oversee staffing arrangements and ensure efficient operation within their entity.
The managerial account possesses the capability to view and modify various aspects within the defined scope of a single entity, excluding modification of records (Refer 5.2.13) of including own scope.
The manager has access to detailed information such as order details, taxation records, staff information, staff attendance records, platform fee details, and settlement information within scope. The manager shall be responsible for preservation of records within his own scope.
The manager shall receive daily, weekly, monthly reports from Dinzyy related to different transactions taken place within his own scope.
The manager shall not share their login credentials or password with any other individual. Dinzyy shall not assume responsibility for any events or consequences arising from the sharing of the manager’s password.
The manager may contact Dinzyy for issues,reports within their own scope. In the event of any issues raised by customers and addressed to Dinzyy within scope (of that entity), the manager assumes responsibility for responding to inquiries and cooperating with any investigations or findings conducted by Dinzyy.
In rare instances of non-confirmation from customers and bookings from customers, as outlined in section 6 of this document, Dinzyy shall disclose the phone number of the respective customer upon request. The manager is permitted to utilize this number solely for communication pertaining to the specific transaction in question. Under no circumstances shall this number be shared with any other party. In the event of complaints related to privacy breaches, the manager shall bear responsibility.
The manager is hereby instructed to thoroughly review the Terms and Conditions, Privacy Policy, and Refund Policy for appropriate management of accounts.
In case of smaller entities where Administrator and manager are the same, it is recommended to use managerial access for daily tasks.
The Manager is tasked with the responsibility of inputting and updating the operational hours of the entity, including opening and closing times.
. This ensures timely responsiveness to various events, such as customer meal booking orders and table reservation requests, which may occur at any time during operational hours.
Managerial Access includes three toggle buttons granting self-access to push notifications for Kitchen Administration, Waiter Administration, and Booking Administration/Cashier roles. Activating these buttons enables the Manager to receive relevant notifications corresponding to each respective role. This feature offers enhanced flexibility, accommodating diverse organizational structures and operational requirements effectively.
Similarly, the Manager has the capability to grant access to multiple individuals as well as multiple access to a single individual. For instance, the same person may serve as both Kitchen Administrator and Waiter Administrator. Hence, the Manager can assign access to the same individual for multiple roles as deemed necessary.
7.4.3 Kitchen Admin
The Kitchen Admin must possess a valid Dinzyy account to access the backend system.
The scope of the Kitchen Administrator's responsibilities is confined to activities pertaining to kitchen operations within the establishment.
The Kitchen Administrator is authorized to provide/revoke access to chefs and other helpers.
The Kitchen Administrator is granted access to kitchen-related inventory management, kitchen facilities information, and real-time cooking updates.
The Kitchen Administrator is empowered to review incoming orders from customers and confirm their acceptance. Additionally, they are responsible for directing chefs to prepare the required food items and instructing waitstaff to serve the prepared meals to customers.
The Kitchen Administrator is advised to maintain an active internet connection to receive push notifications promptly regarding incoming orders. This ensures timely awareness of new orders and facilitates efficient management of kitchen-related activities, such as meal preparation and order fulfillment.
In smaller entities where separate roles for Chef and Kitchen Manager are not designated, the Kitchen Manager may assume the responsibilities of both roles. This includes providing approximate timing for food preparation and updating the status of food item completion as required for efficient kitchen operations.
It is essential to note that the responsibilities and limitations outlined above are exclusive to the Kitchen Administrator role on the Dinzyy platform and do not extend beyond the scope of kitchen-related activities.
Dinzyy shall not be held liable for any disputes arising from errors or omissions made by Kitchen Admins in the course of their duties, as outlined in the terms and conditions. Kitchen Admins are solely responsible for the accuracy and integrity of their actions within the Dinzyy platform.
7.4.4 Waiter Admin
The Waiter Admin must possess a valid Dinzyy account to access the backend system.
Only entities belonging to the category of restaurants can have waiter admin.
The Waiter Admin is authorized to assign authority of specific table numbers to individual waiters. For instance, the Waiter Admin may allocate Table Numbers 7, 8, 9, and 10 to Waiter A.
The Waiter Admin shall receive notifications for each incoming order as well as customer’s requirements and supervise the activities of waiters, ensuring efficient coordination with the Kitchen Administrator to fulfill orders promptly. Notifications about prepared items from the kitchen shall also be received by the waiter manager. Hence it is advisable to maintain active internet connection during operational hours.
Apart from order management, the Waiter Admin is also responsible for overseeing instructions provided to waiters.
Given oversight of all waiter activities and statuses, the Waiter Admin is empowered to optimize waiter deployment. For instance, if the Waiter Admin observes that a waiter assigned to Group A is available while Group B is experiencing a heavy workload, the Waiter Admin may temporarily reassign a waiter from Group A to assist Group B.
In their capacity as an administrator, the Waiter Admin has the authority to accept orders from any table. Therefore, during peak periods, the Waiter Admin may also assume order-taking responsibilities to alleviate workload pressures.
Points 5, 6, and 7 serve as feature introductions and operational guidelines for the Waiter Administrator, aimed at enhancing system efficiency.
Dinzyy shall not be held liable for any disputes arising from errors or omissions made by Waiter Admins in the course of their duties, as outlined in the terms and conditions. Waiter Admins are solely responsible for the accuracy and integrity of their actions within the Dinzyy platform.
7.4.5 Hospitality Admin
The Hospitality Admin must possess a valid Dinzyy account to access the backend system.
Only entities belong to the category of restaurants can have this role.
It encompasses three different roles : receptionist, booking administrator and cashier.
The Hospitality Admin shall oversee all types of bookings as outlined in Section 6 of the terms and conditions.
The Hospitality Admin will receive notifications for each successful booking, as well as notifications for booking failures. Dinzyy emphasizes the necessity for Hospitality Admin to maintain a continuous internet connection and regularly review push notifications to maximize the utilization of Dinzyy's features.
The Hospitality Admin is responsible for confirming bookings five minutes prior to the scheduled booking time.
Acting as the primary point of contact for general customers, the Hospitality Admin shall assist customers in the event of booking failures from their app, facilitating bookings on their behalf as necessary.
The Hospitality Admin will guide customers to their booked tables upon arrival.
In cases of late booking confirmations from customers, as detailed in Section 6.2, the Hospitality Admin shall inform the manager after the specified period has elapsed, prompting the manager to contact the customer to remind them of their booking.
For hunger mode bookings, the Hospitality Admin shall provide confirmation that will send notification to the kitchen 30 minutes prior to the booking time to commence food preparation. Similarly, In rare cases of cancellation of hunger mode order, Hospitality Admin is responsible for notifying kitchen admin about order cancellation.
The Hospitality Admin shall confirm payment receipts and check for any outstanding dues from customers.
In instances where customers opt for cash payments, the Hospitality Admin shall enter the OTP provided by the customer to confirm payment.
The Hospitality Admin is responsible for printing out bills for customers from the billing services desk.
It is recommended for Hospitality Admin to go through section 6 for better understanding of overall system.
Dinzyy shall not be held liable for any disputes arising from errors or omissions made by Hospitality Admins in the course of their duties, as outlined in the terms and conditions. They are solely responsible for the accuracy and integrity of their actions within the Dinzyy platform.
7.4.6 Chef
The chef must possess a valid Dinzyy account to access the backend system.
The Chef does not possess any authority to assign roles or tasks to any other individual within the Dinzyy platform.
The Chef shall receive notifications for orders assigned by the Kitchen Manager through the Dinzyy platform. Hence it is advisable to maintain active internet connection during operational hours.
The Chef must provide approximate completion times for food preparation orders on a per-order basis, aiding in efficient kitchen operations and order management.
Upon receiving orders, the Chef is responsible for updating the status of prepared food items to facilitate further actions by the Kitchen Manager, whether it involves serving or packaging, as per the instructions provided.
Dinzyy shall not be held responsible for any inaccuracies or false information provided by the Chef regarding food preparation, order statuses, or any other related matters within the Dinzyy platform.
7.4.7 Waiter
The waiter must possess a valid Dinzyy account to access the backend system.
Only entities belonging to the category of restaurants can have this role.
Waiter role includes various roles of busser, dishwasher, food-runner etc. defined by the entity.
The waiter does not possess any authority to assign roles or tasks to any other individual within the Dinzyy platform.
The waiter shall receive notifications for orders assigned by the Waiter Manager through the Dinzyy platform. Hence it is advisable to maintain active internet connection during operational hours.
In case, there is no waiter manager, a waiter shall receive notifications for tables assigned to him. These notifications include customer’s orders, customer requirements and prepared items from the kitchen.
Based on these instructions and as per their defined roles, waiters shall carry-out their duties.
Please be advised that the roles and terms and conditions delineated in section 7.4 are presented in a generalized manner and are contingent upon ideal circumstances. It is incumbent upon the entity or owner to thoroughly review and comprehend these features, exercising their judgment to define and determine their applicability. The size of the entity, operational methodologies, staff numbers, and other pertinent variables may influence the implementation of these roles.
Dinzyy will facilitate entities in setting up and defining roles, and in the event of any encountered issues, Dinzyy will provide assistance and guidance.
Dinzyy reserves the right to make minor adjustments to the roles and their corresponding authorities based on feedback received from the entities. Any modifications to the roles will be available in this document and also communicated via email to the administrators of the respective entities.
7.5 Table Booking Services
Prior to perusing the terms and conditions governing table booking services for entities, it is advisable to familiarize oneself with table booking procedures from the customers' perspective, as delineated in sections 6.2, 6.3, and 6.4 of this document. These sections elucidate the various types of table booking services offered to customers.
The terms and conditions for table bookings are as follows:
The entity is required to provide and update data in accordance with the guidelines and conditions outlined in section 7.3.2. Compliance with these guidelines is essential for the seamless operation of booking services.
The entity retains the option to accept only Normal bookings and may choose to disable Hunger mode/Pre mode bookings by toggling the corresponding button within the application interface. Normal mode bookings cannot be disabled. Additionally, any bookings carried out, before Hunger mode/Pre mode disabling, cannot be canceled.
It is mandatory for all staff members to update relevant data in real-time within the application as specified in section 7.4. Failure to provide accurate data may result in the dissemination of false information to customers. Dinzyy shall not assume responsibility for any inaccuracies resulting from false data provided by entity staff.
The Hospitality Admin possesses the authority to view all bookings and in case of physical booking, best judgment shall be used for carrying out booking to ensure optimum waiting time for customers.
The Hospitality Admin reserves the right to cancel bookings in genuine cases on behalf of customers. They are authorized to determine whether the customer's CRR (Cancellation Rate Ratio) will be affected by the cancellation.
Further, given that all bookings are accessible within the entity's system, there may arise circumstances where the Hospitality Admin deems it necessary to optimize wait times for customers by canceling and rebooking available tables on their behalf. However, this action shall only be executed after obtaining explicit confirmation from the customer. To facilitate this process, a designated button seeking the customer's permission will be made available. Any rebooking of tables can only be initiated subsequent to obtaining explicit consent from the customer. However, it is worth noting that this process should not affect booking of any other customers. This process is based on manual judgment and the app can not control human factors, hence Dinzyy does not take responsibility for errors in this transaction.
Upon preparation of a table, the Hospitality Admin will activate a button within the application interface to send a notification to the customer indicating the readiness of the table. If the customer fails to confirm within the stipulated 5-minute timeframe as outlined in clause 6, the Hospitality Admin shall initiate contact following the guidelines provided.
In the case of group bookings where table availability times differ, the Hospitality Admin will sequentially activate buttons for tables belonging to the same group.
The Hospitality Admin is mandated to inform the kitchen administrator 30 minutes before the scheduled booking time for hunger mode orders, facilitating advanced meal preparation. A distinct function is designated for this purpose. Neglecting to do so may result in the failure to fulfill orders punctually, for which the Hospitality Admin bears responsibility. In rare cases of cancellation of hunger mode order, Hospitality Admin is responsible for notifying kitchen admin about order cancellation.
The Hospitality Admin is responsible for guiding guests to their designated tables and ensuring a smooth transition to their seating arrangements.
7.6 Meal-ordering Services
This clause is applicable to restaurants only.
Once seated, customers have the option to place meal orders through the Dinzyy application. This meal ordering service operates under two scenarios: either the customer directly submits their order through the app, or they request the waiter to place the order on their behalf.
In both scenarios, upon final confirmation, orders are transmitted to the kitchen administrator. As outlined in section 7.4.3, notifications pertaining to these orders will be received on the administrator's device.
From the time of order receipt until order fulfillment, it is advisable for all staff members to fulfill their respective responsibilities as outlined in section 7.4, in order to achieve optimal outcomes and ensure customer satisfaction.
Dinzyy bears no responsibility for inaccuracies in data entry or failure to adequately review notifications by kitchen staff.
7.7 Meal Booking Services
Prior to perusing the terms and conditions governing meal booking services for entities, it is advisable to familiarize oneself with meal booking procedures from the customers' perspective, as delineated in sections 6.5 of this document. These sections elucidate the various types of meal booking services offered to customers.
The terms and conditions for meal bookings are as follows:
Within the meal booking feature, customers are expected to make meal reservations through the Dinzyy app. These meal booking orders will be directed to the kitchen administrator. It is strongly recommended to maintain an active internet connection during operational hours to promptly receive notifications and take appropriate action on them.
Upon receipt of meal booking order notifications, users will be redirected to the booking page. It is advisable to input an estimated meal preparation time into the system to provide customers with a reasonable expectation, conveyed via notifications, regarding the timing of their visit to the establishment.
If the order type is designated as 'Book A Meal,' the meal should be prepared at the specified time. Conversely, if the order type is 'Takeaway,' the meal should be prepared and packed by the indicated time.
Upon the customer's arrival at the establishment, they are required to present the booking confirmation page or confirmation email. The Hospitality Administrator will verify this by entering the necessary details and settling any outstanding dues, if applicable. Subsequently, the Hospitality Administrator will press the confirm button to conclude the transaction.
Dinzyy bears no responsibility for errors made by staff or inaccuracies in data provided by staff members.
7.8 Banquet Booking Services
To be eligible for registration to offer Banquet booking services, an entity must possess a designated space as outlined in section 5.1.13.
Moreover, an entity shall provide all the data as outlined in 7.3.6.
Banquets have the authority to accept or reject banquet booking requests made through the Dinzyy app. The decision to accept or reject a booking request lies solely with the banquet management. Banquets must promptly communicate their acceptance or rejection of booking requests to Dinzyy for further processing.
The authority for acceptance/rejection of these details is vested in accounts designated as administrators and managers.
Banquets may require users to make advance payments for booking their facilities.
Banquets will receive notifications via email or push notifications upon receiving a booking request (after successful advance amount payment by customer through Dinzyy payment gateway) through the Dinzyy app. Similarly, users will receive notifications upon the banquet's acceptance or rejection of their booking request.
Banquets are responsible for paying platform fees to Dinzyy for facilitating banquet bookings through the app.
Platform fees as well as advanced amounts received will be settled during settlement.
Banquets must ensure the accuracy of their availability status on the Dinzyy platform. To ensure accuracy banquets are advised to update bookings received through offline mode in Dinzyy app as well. Dinzyy will not charge anything for such bookings. Any changes in availability must be promptly updated to avoid double bookings or misunderstandings with users.
Banquets must specify the start and end times for the usage of their facilities during the booking process. Any extensions or modifications to the booking duration must be communicated to users and updated on the Dinzyy platform accordingly.
Banquets acknowledge that Dinzyy serves solely as a platform for facilitating banquet bookings and does not assume liability for any issues arising during the usage of banquet facilities. Banquets are responsible for addressing any disputes or concerns raised by users regarding their facilities or services.
Banquets agree to cooperate with Dinzyy in promptly investigating and resolving any issues or complaints raised by users regarding their facilities or services booked through the Dinzyy app. Banquets must provide necessary assistance and information to Dinzyy for the resolution of such issues.
7.9 Billing Services
During a table-booking transaction, a bill shall be generated either when a customer requests it through the Dinzyy app or when a waiter initiates the request on behalf of the customer to conclude the transaction.
An order summary will be made available to customers electronically. However, as printed copies may be required by customers, the Hospitality Manager may generate a print-out from the Dinzyy app and provide it to the customer upon request.
Payment for the bill can be made through two methods: either the customer pays via Dinzyy's payment gateway on the app, or the customer pays in cash. In instances where cash payment is utilized, the Hospitality Manager is required to input and authenticate the OTP displayed within the customer's app using their own login credentials.
By verifying the OTP, the entity confirms that there are no outstanding dues from the customer for that transaction. The transaction shall not be considered complete until the OTP is verified, and it will remain open until then.
If the payment is made through Dinzyy's payment gateway, the settlement of that amount with the entity shall be conducted in accordance with the settlement rules.
Both the Hospitality Manager and the Manager are required to ensure the smooth processing of billing transactions.
7.10 Other backend services
Dinzyy is diligently working on expanding its range of backend services for entities. These services are currently in development and are scheduled to be launched in the near future.Once launched, it shall be updated in this document and also an email to the administrator shall be sent for updates.
8. PLATFORM FEES & CHARGES
The practical examples provided in this section are intended for the purpose of enhancing user comprehension and facilitating a clearer understanding of the stipulated provisions. These examples serve as illustrative aids to elucidate the application and implications of the outlined terms and conditions. It is imperative to note that these examples are provided solely for convenience and do not supersede or alter the legal validity or enforceability of the terms and conditions themselves.
8.1 Platform fees
Platform fees refer to the charges levied by Dinzyy from customers as well as registered entities (Registered Dinzyy vendors) for the utilization of its application platform and services provided therein.
Customers shall incur flat platform fees, the determination of which lies within the discretion of Dinzyy. In contrast, vendors shall be subject to variable platform fees, the calculation of which is contingent upon the terms stipulated in the agreement between Dinzyy and the respective vendor.
Dinzyy shall ensure transparency in disclosing the platform fees to customers prior to the completion of the transaction. The platform fees will be clearly outlined in the checkout process, allowing customers to review and acknowledge the associated charges.
Customers are obligated to remit the platform fees as part of the total transaction amount. Failure to pay the platform fees may result in the suspension or termination of access to Dinzyy services.
Platform fees are non-refundable once the transaction is completed unless otherwise specified in Dinzyy's refund policy.
Customers acknowledge that Goods and Services Tax (GST) may be applicable on the platform fees as per prevailing taxation regulations. The GST amount will be added to the platform fees and reflected in the total transaction amount.
In the event of any disputes or discrepancies regarding the platform fees, customers are encouraged to contact Dinzyy's customer support for resolution.
By using the Dinzyy application and availing its services, customers agree to comply with the platform fees terms and conditions outlined herein.
Dinzyy reserves the right to take appropriate legal action against customers found to be in violation of the platform fees terms and conditions, including but not limited to the recovery of unpaid fees and suspension of account privileges.
8.2 Payment processing Charges
This section pertains exclusively to entities registered with Dinzyy. General customers are not subject to these charges.
Dinzyy utilizes a third-party payment gateway for processing transactions. As such, Dinzyy imposes charges on entities for each payment processed through our payment gateway. These charges amount to 2.40 % of the transaction value plus applicable Goods and Services Tax (GST).
Entities have the option to accept payments in cash when customers are physically present to settle their dues. Terms and conditions for cash payments have been outlined in section 10.2.
The aforementioned charges are fixed and uniform for all transactions unless entities qualify for an exclusive offer from Dinzyy. Any such offer shall be valid for a limited period and subject to the terms specified by Dinzyy.
Dinzyy reserves the right to modify the payment processing charges periodically. Entities shall receive notifications via email at their registered email addresses regarding any changes to these charges.
9. SETTLEMENT
This section does not pertain to general customers but is applicable to registered entities.
The practical examples provided in this section are intended for the purpose of enhancing user comprehension and facilitating a clearer understanding of the stipulated provisions. These examples serve as illustrative aids to elucidate the application and implications of the outlined terms and conditions. It is imperative to note that these examples are provided solely for convenience and do not supersede or alter the legal validity or enforceability of the terms and conditions themselves.
Settlement (refer 5.2.14) is governed by following terms and conditions :
The platform fees paid by (genral) customers, in addition to any other charges incurred through Dinzyy's services, shall be included in the bill generated for each transaction. For a single entity, the grand total of the platform fees paid by customers, platform fees to be paid by entities and applicable GST on both (customer and restaurant platform fees) types of platform fees for each transaction shall be done during each settlement period (Refer 5.2.15). Moreover, this grand total shall include payment processing charges (Refer 8.2) as well as GST on these charges, for whichever transaction the payment has been processed through Dinzyy during the settlement period. This grand total amount shall be paid to Dinzyy by the entity. Let say this amount “Dinzyy charges” for a settlement period.
Additionally, during the same settlement period, the grand total of payment received at Dinzyy’s payment gateway for the same entity shall be done. Let say this amount “Dinzyy liability” for the settlement period.
Customers have the option to settle their bills through Dinzyy's third-party payment gateway or directly at the entity's premises, as per their preference. Regardless of the payment method chosen, all platform fees shall be settled with Dinzyy.
Scenario - 1 Excess Payment :For during a settlement period, if Dinzyy liability turns out to be higher than Dinzyy charges, Dinzyy shall reimburse the excess amount equals to Dinzyy liability minus Dinzyy charges to the entity.
Scenario - 2 Insufficient Payment: For during a settlement period, if Dinzyy liability turns out to be lesser than Dinzyy charges, Entity shall pay the excess amount equals to Dinzyy charges minus Dinzyy liability to Dinzyy.
Dinzyy shall generate invoices detailing the platform fees, payment gateway charges, applicable GST on both types of platform fees, applicable GST on payment gateway charges and any other applicable fees during a settlement period. These invoices shall be sent to the entities via email on administrator (7.4.1) and/or managerial account (7.4.2) for the settlement at the end of settlement period.
Entities shall go through the invoice within 48 hours after receipt of an invoice and in case of any miscalculation/errors, entities shall notify Dinzyy about issues. If an entity does not notify us about within the aforementioned time, Dinzyy shall assume that invoice is checked by the entity and it does not have any errors.
Post invoice checking period (i.e. 48 hours after receipt of an invoice), Dinzyy shall pay to the concerned entities within 36 hours in case of excess payment (Refer point 5), whereas for insufficient payment (Refer point 6) Dinzyy expects the payment from the concerned entities within 36 hours post invoice checking period. Payment gateway is provided to administrator (7.4.1) and/or managerial account (7.4.2) for seamless payment to Dinzyy.
Dinzyy shall send transactional emails to the administrator (7.4.1) and/or managerial account (7.4.2) after payment to the entity and after successful payment receipt from the entity.
Failure by the restaurant to pay the outstanding charges in a timely manner may result in the suspension of services by Dinzyy. Additionally, Dinzyy reserves the right to take further legal actions to recover the outstanding amounts.
All settlement amounts shall be denominated in Indian rupees only.
Dinzyy reserves the right to modify or update these settlement terms and conditions as deemed necessary. Any changes to the terms shall be communicated to the entities in advance through email and shall be applicable to the future transactions.
10. PAYMENT
For the payment, general customers may select any of the following methods, subjected to practical applicability (Refer 10.2 point 3 for practical limitation of Cash acceptance facility).

10.1 Third Party Payment gateway
Dinzyy app facilitates payment processing through a third-party payment gateway for its customers.
By utilizing the payment processing services offered by Dinzyy, customers agree to abide by the terms and conditions outlined herein.
Dinzyy utilizes a third-party payment gateway to process payments made by customers. The terms and conditions of the third-party payment gateway provider also apply to all transactions conducted through the Dinzyy app.
Dinzyy ensures the security and confidentiality of customer payment information during the payment processing procedure. However, Dinzyy shall not be held liable for any unauthorized access or misuse of customer payment details by the third-party payment gateway provider.
In the event of any disputes or discrepancies related to payments processed through the Dinzyy app, customers are advised to contact Dinzyy's customer support for resolution assistance. Dinzyy shall make reasonable efforts to address and resolve payment disputes in a timely manner.
By initiating a payment transaction through the Dinzyy app, customers authorize Dinzyy and its third-party payment gateway provider to process the payment using the payment method specified by the customer.
Upon successful completion of a payment transaction, customers will receive confirmation of the payment via the Dinzyy app and/or email. It is the customer's responsibility to verify the accuracy of the payment details provided during the transaction.
Refunds for payments made through the Dinzyy app are subject to the refund policies of both Dinzyy and the third-party payment gateway provider. Customers may request refunds in accordance with the applicable refund policies and procedures.
All payment transactions conducted through the Dinzyy app shall comply with applicable laws, regulations, and industry standards governing payment processing and financial transactions.
Dinzyy reserves the right to modify or update these terms and conditions for payment processing at any time without prior notice. Customers are encouraged to review the terms periodically for any changes.
These terms and conditions for payment processing shall be governed by and construed in accordance with the laws of the jurisdiction of India.
By using the payment processing services offered by Dinzyy, customers acknowledge and agree to abide by these terms and conditions. Failure to comply with these terms may result in the termination or suspension of access to Dinzyy's payment processing services.
10.2 Cash Acceptance Facility
The provision of cash acceptance facility is extended solely for the benefit of entities.
Entities have the option to accept payments in cash when customers are physically present to settle their dues. To facilitate cash payments, entities are required to enter the One-Time Password (OTP) provided by the customer into their respective applicable login portals (as outlined in sections 7.4.1, 7.4.2, and 7.4.5, which have payment acceptance rights).
In circumstances where customers are not physically present during the payment of advance amounts for hunger mode/meal bookings, cash acceptance is neither practically feasible nor permissible. However, when customers are physically present for the final payment, entities retain the discretion to accept cash payments.
Consequently, it is the responsibility of entities to accept and accurately record cash payments within Dinzyy’s system. Any discrepancies or errors in recording payments resulting in outstanding dues from customers shall be attributed to the entity.
In the event of disputes arising from such instances, Dinzyy hereby disclaims any responsibility or liability.
11. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of the Services, you agree not to:
Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.
Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
Use any information obtained from the Services in order to harass, abuse, or harm another person.
Make improper use of our support services or submit false reports of abuse or misconduct.
Use the Services in a manner inconsistent with any applicable laws or regulations.
Engage in unauthorized framing of or linking to the Services.
Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
Delete the copyright or other proprietary rights notice from any Content.
Attempt to impersonate another user or person or use the username of another user.
Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1x1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms").

Apple and Android Devices
The following terms apply when you use the App obtained from either the Apple Store or Google Play (each an "App Distributor") to access the Services:
(1) the license granted to you for our App is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor's terms of service;
(2) we are responsible for providing any maintenance and support services with respect to the App as specified in the terms and conditions of this mobile application license contained in these Legal Terms or as otherwise required under applicable law, and you acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the App;
(3) in the event of any failure of the App to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the App, and to the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the App;
(4) you represent and warrant that (i) you are not located in a country that is subject to a US government embargo, or that has been designated by the US government as a "terrorist supporting" country and (ii) you are not listed on any US government list of prohibited or restricted parties;
(5) you must comply with applicable third-party terms of agreement when using the App, e.g., if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the App; and
(6) you acknowledge and agree that the App Distributors are third-party beneficiaries of the terms and conditions in this mobile application license contained in these Legal Terms, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce the terms and conditions in this mobile application license contained in these Legal Terms against you as a third-party beneficiary thereof.
